TRACKMYID SPECIAL TERMS OF USE


  1. OVERVIEW AND ACCEPTANCE OF TERMS
    1. These TrackMyID Special Terms of Use (“Special Terms“) govern access to and use of Experian's TrackMyID Service by User. These Special Terms are supplemental and in addition to Experian Terms of Use. In the event of any conflict or inconsistency between these Special Terms and Terms of Use, these Special Terms shall prevail.
    2. By accessing and using TrackMyID Service, User agrees to be bound by and comply with these Special Terms.
    3. Experian reserves the right to modify these Special Terms at its sole discretion without notice to User. User's continued use of TrackMyID Service following the modifications constitutes an acknowledgement and acceptance of the amended terms and an agreement to abide and to be bound by the amended terms.
  2. DEFINITIONS
    1. Except where expressly otherwise defined, capitalised terms used in these Special Terms shall have the meaning given to them in the Terms of Use.
    2. The following words and expressions shall have the following meanings:
      1. Member of the Experian Group means any company controlling, controlled by or in common control with Experian from time to time and control means direct or indirect ownership of 50% or more of the voting equities or equivalent of the relevant company.
      2. Terms of Use means Experian internet website https://www.experian.com.my/consumer terms of use available at the above mentioned website;
      3. TrackMyID Service means the service described in Clause 3 below.
  3. TRACKMYID SERVICE DESCRIPTION
    1. TrackMyID Service is an identity monitoring and tracking tool which provides alerts notifying User of data compromises or any changes to User's monitored information. TrackMyID Service is meant to enable User to monitor their information on the internet, including the Dark Web (part of the internet that is not indexed by search engines).
    2. The monitored information includes the following personal information selected and indicated by User upon registration to TrackMyID Service

    4. If there is an information found to be compromised, Experian will inform User of the details (to the extent possible) via text or email as per User's selection.
    5. Disclaimer. Because the Internet is vast, Experian cannot guarantee that alerts and notifications, including any internet surveillance scans and reports, will detect all possible instances of identity theft and/or potentially fraudulent, or otherwise improper, use of User's information. Certain information contained in the alerts and notifications may be obtained from criminal activities monitored on the Internet. Due to the dynamic nature of this data, the exchange platforms, and the fact that it may have been obtained from criminals, among other considerations, Experian cannot guarantee, and is therefore not able to accept any liability arising from or in connection with, the accuracy or completeness of the alerts and notifications provided.
  4. REPRESENTATIONS AND WARRANTIES
    1. User agrees to provide to Experian and keep its information true and accurate in the course of using TrackMyID Service. User acknowledges that the accuracy of alerts and notifications is linked to the accuracy of the information given by the User.
    2. In circumstances where User may have provided information relating to third parties (e.g. email addresses of family members, spouse, emergency contact persons, etc.), User represents and warrants to Experian that they obtained such third parties' consent or are otherwise entitled to provide their information to Experian. User shall fully indemnify Experian against any and all losses, damages, liabilities, claims, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising out of or in connection with any breach by the User of the representations and warranties under this Clause 4.2.
  5. COLLECTION AND USE OF YOUR PERSONAL INFORMATION
    1. User understands and agrees that, by enrolling for the TrackMyID Service, User expressly consents to Experian, any Member of Experian Group and their service providers (i) to collect, process, disclose and transfer User's personal information (including outside Malaysia) only for the purpose of providing TrackMyID Service and (ii) to use technologies that serve as an Internet surveillance, proactively detecting User's personal information that is unduly exposed.
  6. SERVICE TERM AND TERMINATION
    1. Access to and use of TrackMyID Service are available to Users for a period specified upon enrolment (“Initial Term“). Upon expiry of the Initial Term, access to and use of TrackMyID Service will automatically renew for additional subsequent periods of 12 months each (“Additional Term“), subject to payment of applicable fee, unless terminated by Experian or User in accordance with this Clause 6.
    2. User can terminate use of TrackMyID Service any time by contacting Experian Consumer Support Division at +60326151100 or consumer-my@experian.com. No refund will be made for any fee paid in advance.
    3. Experian shall be entitled, at its sole discretion, to immediately suspend or terminate provision of TrackMyID Service if:
      1. The User is in breach of Terms of Use and/or these Special Terms; or
      2. The User revokes or withholds a consent to the collection, processing, disclosure or transfer of User's personal information in accordance with these Special Terms and/or Experian's Privacy Statement and, as a result, Experian is no longer able to provide TrackMyID Service to User; or
      3. Experian is required to do so by law; or
      4. Any information provided by User is untrue or inaccurate, or if Experian has reasonable grounds to suspect that such information is untrue or inaccurate.
  7. MISCELLANEOUS
    1. If any part of these Special Terms is found to be invalid or unenforceable by any Court or other competent body, such invalidity or unenforceability shall not affect the other provisions of these Special Terms and such other provisions shall remain in full force and effect.
    2. These Special Terms and all matters arising out of it shall be governed by, and construed in accordance with, the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any claim or matter which may arise out of or in connection with these Special Terms.
    3. Nothing in these Special Terms shall be construed as creating a right which is enforceable by any person other than Experian and the User.
